By accessing or using ViralRise ("Service," "Platform"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, do not use the Service. We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes your acceptance of the updated Terms. We will notify you of material changes via email.
ViralRise is an automated content generation and social media publishing platform. The Service: • Analyzes your business website URL to understand your brand and products • Generates marketing photos and short-form videos using AI • Publishes content to your connected social media accounts (Instagram, TikTok) at your direction • Provides a dashboard to manage your connected accounts and view post history The Service is provided on a subscription basis. Access requires account registration and an active subscription.
To use ViralRise, you must: • Be at least 18 years of age • Register with a valid email address • Provide accurate and complete information You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately at support@viralrise.app if you suspect unauthorized access. You may not create accounts for others without their consent, or create multiple accounts to circumvent restrictions.
ViralRise integrates with third-party platforms including TikTok and Instagram. By connecting these accounts you agree to the following: TikTok: • Your use of TikTok features through ViralRise is subject to TikTok's Terms of Service (tiktok.com/legal/terms-of-service) and Community Guidelines • ViralRise accesses your TikTok account solely to publish content you generate and approve within our platform • We request only the minimum permissions required: user.info.basic, user.info.stats, video.upload, video.publish • You may revoke ViralRise's TikTok access at any time via TikTok's app settings or by disconnecting from your ViralRise dashboard • ViralRise is not affiliated with or endorsed by TikTok Instagram / Meta: • Your use of Instagram features is subject to Meta's Terms of Service and Platform Policies • We request only instagram_business_basic and instagram_business_content_publish permissions • You may revoke access at any time via Meta's app settings or your ViralRise dashboard • ViralRise is not affiliated with or endorsed by Meta ViralRise is not responsible for changes to third-party APIs, platform policies, or service availability that may affect functionality.
You agree to use ViralRise only for lawful purposes. You must NOT: • Publish content that violates any applicable law or regulation • Infringe on intellectual property rights of third parties • Publish spam, misleading, deceptive, or fraudulent content • Violate TikTok's, Instagram's, or any other platform's Terms of Service or Community Guidelines • Use the Service to harass, harm, or discriminate against any individual or group • Attempt to reverse-engineer, hack, or compromise the Service • Use the Service to generate content that includes violence, nudity, or hate speech • Circumvent any usage limits or access controls We reserve the right to suspend or permanently terminate accounts that violate these Terms, without refund.
Your content: You retain ownership of your business content, brand materials, and any content generated using your data through ViralRise. License to ViralRise: By using the Service, you grant ViralRise a limited, non-exclusive, royalty-free license to process, store, and transmit your content solely for the purpose of providing the Service. This license terminates when you delete your account. Your responsibility: You are solely responsible for ensuring that all content published through ViralRise complies with applicable laws and the terms of each platform (TikTok, Instagram). ViralRise is a tool — you remain responsible for the content you choose to publish. AI-generated content: Content generated by our AI is provided "as is." We do not guarantee accuracy, appropriateness, or effectiveness. Review all content before publishing.
ViralRise is offered on a subscription basis, processed through Gumroad: • 1-Month Plan: $39/month (billed monthly) • 3-Month Plan: $99 / 3 months By subscribing, you authorize recurring charges to your payment method. All fees are in USD. Cancellation: You may cancel your subscription at any time via Gumroad. Cancellation takes effect at the end of your current billing period. You retain access through the end of the paid period. Refunds: See our Refund Policy at viralrise.app/refund. We reserve the right to change pricing with 30 days' notice to subscribers.
To the maximum extent permitted by applicable law: • ViralRise is provided "as is" and "as available" without warranties of any kind • We do not warrant uninterrupted, error-free, or results-guaranteed operation • We are not liable for content published to third-party platforms through our Service • We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities • Our total liability to you shall not exceed the amount you paid to ViralRise in the 3 months preceding the claim Nothing in these Terms limits liability that cannot be excluded by law (e.g., gross negligence, willful misconduct).
You may terminate your account at any time by contacting support@viralrise.app. We may suspend or terminate your account immediately if: • You violate these Terms • We are required to do so by law • Your use poses security or legal risk to ViralRise or other users Upon termination, your right to use the Service ceases immediately. We will delete your data per our Privacy Policy retention schedule. Sections 6, 8, 10, and 11 survive termination.
You agree to indemnify, defend, and hold harmless ViralRise and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from: • Your use of the Service • Content you publish through the Service • Your violation of these Terms • Your violation of any third-party platform's terms (TikTok, Instagram, etc.) • Your violation of any applicable law
These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation first, and if unsuccessful, through binding arbitration. If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
